CALDWELL — Defense attorneys for 14-year-old Zach Neagle, accused of killing his father in May, waived Neagle's right to a speedy trial today to postpone his jury trial to Jan 5. Neagle's defense said in cout they need more time to prepare for the trial
Third District Judge Bradly Ford has approved a psychological evaluation of Neagle requested by the defense.
Neagle's father Jason Neagle died from a single gunshot wound from a high-powered rifle on May 16 in the family's home in Caldwell.
The new jury trial is scheduled to begin at 1 p.m. The court also postponed a pre-trial hearing set for today to 8:30 a.m. Nov. 24. Status conferences in the case are scheduled for Dec. 23 and Dec. 28, but the latter conference could be canceled, Ford said, if status issues are resolved Dec. 23.
Neagle, who was a student at Vallivue Middle School, was arrested on a warrant for first-degree murder after an interview with Caldwell police. Neagle did not confess to the murder during police interviews, nor did he deny it when presented with the evidence against him.
A family member told police he suspected Jason Neagle sexually abused his son.
Neagle has been assigned a guardian ad litem, Scott Gatewood, to act as his advocate as in the case.
