Justin Mark Eilers, 30, of Boise, the man shot and killed near Nampa Christmas night, was a champion professional mixed martial arts fighter. James Robert Malec, 48, charged with second degree murder in the incident, formerly worked as a Canyon County Sheriff Office jailer.

Malec is accused of shooting Eilers after an argument at the home of Malec and his girlfriend or wife, Eilers' mother, police said.

Eilers died of a single gunshot wound to the chest, county coroner Vicki DeGeus-Morris said. The coroner's office identified the death as a homicide.

Malec was booked into the Canyon County  jail late Thursday on the murder charge and arraigned today.

Law enforcement officials became aware of the incident Thursday night when the sheriff's office responded to a domestic disturbance in the 4600 block of South Happy Valley Road near Nampa at 10:44 p.m. The call was upgraded to a response to a shot fired.

When deputies arrived on the scene, Eilers had been shot and Malec was taken into custody. Emergency response workers could not revive the gun shot victim.

"They ended up having a verbal altercation," Canyon County Sheriff Chris Smith said. "It was just a personal thing." Smith said alcohol was involved in the incident.

sorry to hear of the lose justin was a good guy he had thanksgiven with us in 2007 we talked and watch football when he was in vegas a kid that was working his way back to the top of the fight game.and got his life taken from him now is son with out a father.and now farther with out a son.well from 1 dad 2 and other justin was 1 good cat i know him and like him my kids loved him they both cryed their hartes out when i told them. then ask WHY?.that i cant answer but 1 day we can.we will miss you justin love the kowitz family only god can judge u now my brother

It is a very sad situation - and one has to be there to really know what happened. It is also a message that maybe, it was the only choice that the home owner had to defend himself; his guests; and his property. If there was no other choice - this justifiable homicide. Think about - what else or how else can someone defend their people and property against a trained MMA fighter? As human beings; as people with their own right to safety; and the right to defend ourselves - this may have been the only way to exercise that right. All those people out there that think they can just push people around - or who need help with their anger or jealousy or just living a peaceful life - this is another consequence if you do not get some help. Hopefully it nevers come down to it - but if it's down to me or you - I will do what's necessary to defend my property and the people that I Love. Peace!!

Sad news. For those who don't know, Justin Eilers was a professional Mixed Martial Arts fighter and the guy who shot him is his mothers boyfriend. According to a story on Sherdog.com, Eilers had gathered with relatives for the holidays, but tensions escalated with an ex-girlfriend, also in attendance. Eilers was asked to leave the residence, but was said to have refused and began throwing dishes and other objects in protest. The home’s owner was then said to have pulled a gun on Eilers and shot him in the chest after a brief verbal confrontation. Even more tragic, Eiler's mother and young son were said to have been in the room at the time of the shooting.
